2. Nature of Business

Generator Engines operates as a proprietorship concern under Indian law. All transactions are conducted in the name of the proprietor.

We supply:

  • Genuine and OEM diesel engine spare parts

  • Reconditioned engine components

  • Engineering coordination and technical sourcing support

  • Merchant trading services (including third-party dispatch arrangements)

We are not an authorised dealer of any brand unless explicitly stated.

3. Order Process & Contract Formation

We operate on a quotation-based model. No online checkout facility is provided.

Order process:

  1. Enquiry submitted

  2. Custom quotation issued

  3. Written order confirmation

  4. Payment as agreed

  5. Invoice issued

  6. Dispatch arranged

A legally binding contract is formed only when:

  • The quotation is accepted in writing, and

  • Payment terms are fulfilled.

We reserve the right to cancel or decline any order prior to dispatch.

4. Pricing, GST & Taxes

  • Prices are quoted in agreed currency (INR / USD / EUR / GBP etc.).

  • Domestic Indian sales are subject to applicable GST.

  • Export supplies may be treated as zero-rated under Indian GST law (subject to compliance).

  • Import duties, VAT, customs charges, and destination taxes are the responsibility of the buyer.

GST invoice will be issued in accordance with Indian tax regulations.

5. Returns & Refund Policy

Returns are accepted within 14 days of delivery unless otherwise agreed.

Conditions:

  • Item must be unused and undamaged

  • Returned in original packaging

  • Written return request submitted within 14 days

  • Buyer responsible for return shipping

Non-returnable items:

  • Custom or special-order parts

  • Electrical/electronic components once opened

  • Reconditioned parts

  • Clearance or discounted items

  • Hazardous goods

Refunds:

  • Processed after inspection

  • Shipping costs are non-refundable

  • Refund issued to original payment method

Damaged or incorrect goods must be reported within 48 hours with photographic evidence.

6. Warranty & Technical Responsibility

All goods are supplied strictly based on information provided by the buyer, including engine model, serial number, or part reference.

We are not responsible for:

  • Incorrect parts ordered due to inaccurate information

  • Improper installation

  • Mechanical misuse

  • Modification or alteration of parts

  • Failure to follow manufacturer instructions

Manufacturer warranty (if applicable) is limited to manufacturer terms only.

Reconditioned parts carry limited warranty as agreed at the time of sale.

All parts must be installed by qualified professionals.

7. Engineering & Reconditioning Services

Where engineering or reconditioning services are provided:

  • Services are performed based on agreed scope

  • Final inspection responsibility remains with the client

  • Performance depends on overall engine condition

  • We are not liable for consequential mechanical failures

Labour coordination services do not create employer–employee relationships unless formally contracted.

8. Shipping, Delivery & Risk

Delivery terms are agreed at quotation stage and may include:

  • EXW

  • FOB

  • CIF

  • Courier dispatch

Key conditions:

  • Dispatch after full payment unless agreed otherwise

  • Delivery timelines are estimates only

  • Risk transfers as per agreed Incoterms

  • Buyer responsible for customs clearance and import compliance

We are not liable for delays caused by:

  • Customs

  • Freight carriers

  • Government restrictions

  • Force majeure events

9. Limitation of Liability

To the maximum extent permitted under Indian law:

We shall not be liable for:

  • Business interruption

  • Downtime

  • Loss of profit

  • Indirect or consequential damages

  • Installation errors

  • Third-party handling or misuse

Our maximum liability shall not exceed the value of the goods supplied under the relevant invoice.

10. Merchant Trading Clause

In certain transactions, goods may be supplied directly from third-party manufacturers or suppliers to the customer under merchant trading arrangements.

We act as a commercial intermediary in such transactions and shall not be responsible for manufacturing defects beyond supplier warranty terms.
